Deskripsi Singkat:

Indonesia sebagai sebuah negara kepulauan (Archipelagic State) yang sudah meratifikasi serta mengundangkan Konvensi Hukum Laut PBB 1982, dalam beberapa hal sudah mentransformasikan pranata-pranata hukum laut yang diatur di dalam Konvensi tersebut ke dalam peraturan perundang-undangan nasionalnya dalam bidang hukum laut. Salah satu dari pranata hukum laut tersebut adalah landas kontinen sebagaimana dapat dijumpai pengaturannya di dalam Bagian VI Pasal 76-85. Landas kontinen yang sedemikian luasnya ini mengelilingi seluruh kepulauan Indonesia kecuali di area laut dimana laut teritorial Indonesia berbatasan dengan laut teritorial negara-negara sahabat. Pada landas kontinennya itu, Indonesia memiliki hak-hak berdaulat (sovereign rights) untuk mengeksplorasi landas kontinennya dan mengeksploitasi sumber daya alamnya.

Ini menunjukan, betapa penting dan strategisnya landas kontinen itu bagi Indonesia khususnya sumber daya alamnya bagi pembangunan nasional Indonesia. Pengeksplorasian landas kontinen dan pengekspliotasian sumber daya alamnya dilakukan dengan menggunakan teknologi tinggi yang sebagian besar dimiliki oleh perusahaan-perusahaan multinasional asing maupun domestik berdasarkan ijin atau konsesi yang diberikan oleh Pemerintah Indonesia. Sampai disini, landas kontinen tisak saja mengandung aspek teoritis ilmiah tetapi juga aspek aplikatif-praktis.

Atas dasar itu, betapa pentingnya pranata hukum laut yang bernama landas kontinen ini dipelajari dan dipahami baik oleh para ilmuwan dalam bidang kelautan dan hukum laut maupun oleh para praktisi yang bergerak dalam bidang pengeksplorasian landas kontinen tersebut dan pengeksploitasian sumber daya alamnya. Dengan pemahaman yang baik dan benar tentang landas kontinen ini terhindarkanlah pemahaman yang keliru tentang landas kontinen tersebut, misalnya dengan memiliki landas kontinen maka wilayah Indonesia bertambah luas. Pemahaman ini jelas kelitu sebab landas kontinen bukanlah bagian dari wilayah negara.
